{"id":15938,"date":"2020-10-02T18:30:01","date_gmt":"2020-10-02T21:30:01","guid":{"rendered":"https:\/\/www.corenma.gov.br\/site\/?p=15938"},"modified":"2020-10-02T20:30:29","modified_gmt":"2020-10-02T23:30:29","slug":"nota-de-esclarecimento-8","status":"publish","type":"post","link":"https:\/\/corenma.gov.br\/site2\/nota-de-esclarecimento-8\/","title":{"rendered":"NOTA DE ESCLARECIMENTO"},"content":{"rendered":"<div dir=\"auto\">O Conselho Regional de Enfermagem do Maranh\u00e3o \u2013 COREN-MA, vem, esclarecer sobre as elei\u00e7\u00f5es do ano em curso, no tocante o exerc\u00edcio do voto pelos profissionais de enfermagem. Cumpre destacar sobre a Resolu\u00e7\u00e3o n\u00ba 612 de 01 de agosto de 2019, que trata sobre o C\u00f3digo Eleitoral do Sistema COFEN\/COREN\u2019s, em seu art. 9\u00ba \u00e9 bem espec\u00edfico ao afirmar que para votar o profissional dever\u00e1 estar adimplente, veja:<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Art. 9\u00ba Os conselheiros efetivos e suplentes do conselho regional s\u00e3o eleitos por meio de elei\u00e7\u00f5es diretas, mediante voto pessoal, secreto e obrigat\u00f3rio dos *profissionais de enfermagem regularmente inscritos e adimplentes*, devendo o eleitor assinalar \u00e0 chapa de sua escolha, sendo o meio utilizado para registrar o voto, preferencialmente, pela rede mundial de computadores ou na impossibilidade a utiliza\u00e7\u00e3o de urnas eletr\u00f4nicas, urnas convencionais ou o voto por correspond\u00eancia.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Portanto, n\u00e3o cabe ao Conselho Regional de Enfermagem interferir na quest\u00e3o do profissional estar ou n\u00e3o adimplente para exercer seu direito de voto, por tratar-se de um requisito objetivo presente na Resolu\u00e7\u00e3o expedida pelo COFEN.<\/div>\n<div dir=\"auto\">\u00c9 importante, tamb\u00e9m, esclarecer que ao COFEN incube, conforme o art. 8, IV da Lei n\u00b0 5.905 de 12 de julho de 1973, baixar provimentos e expedir instru\u00e7\u00f5es \u00a0aos Conselhos Regionais e, por for\u00e7a disto, a Lei Federal citada confere compet\u00eancia ao COFEN para expedir Resolu\u00e7\u00f5es que s\u00e3o submetidas \u00e0 todos os Regionais.<\/div>\n<div dir=\"auto\">Por fim, ratifica o que consta no art. 12, par\u00e1grafo 2\u00b0, aduz que o eleitor que, sem justa causa, deixar de votar, ser\u00e1 aplicada multa no valor de uma anuidade.<\/div>\n<div dir=\"auto\">Portanto, resta evidente que o Regional \u00e9 submetido \u00e0s normativas do COFEN e, para respeitar a Lei, s\u00f3 pode fazer o que aquele autoriza.<\/div>\n<div class=\"yj6qo\"><\/div>\n<div class=\"adL\" dir=\"auto\"><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Nota de esclarecimento<\/p>\n","protected":false},"author":6,"featured_media":15939,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"site-sidebar-layout":"default","site-content-layout":"default","ast-global-header-display":"","ast-banner-title-visibility":"","ast-main-header-display":"","ast-hfb-above-header-display":"","ast-hfb-below-header-display":"","ast-hfb-mobile-header-display":"","site-post-title":"","ast-breadcrumbs-content":"","ast-featured-img":"","footer-sml-layout":"","theme-transparent-header-meta":"","adv-header-id-meta":"","stick-header-meta":"","header-above-stick-meta":"","header-main-stick-meta":"","header-below-stick-meta":"","footnotes":""},"categories":[453,1,39,6,2],"tags":[],"class_list":["post-15938","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-eleicoes-2020","category-geral","category-informativos-coren-ma","category-legislacao","category-noticias"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v20.11 -
